[Cherry Cloud] is a service provided by Cherry Solution Co., Ltd. (hereinafter referred to as "Cherry Solution "  or "We") including login, owner registration, organization registration, adding power plants, adding devices, power plant management, device management, device AP network configuration, device Bluetooth network configuration, etc. Please read our Privacy Policy carefully. If you have any questions, please inform us. This Policy represents our commitment to the protection of your personal information, which we will strictly adhere to. We hope you feel secure and can use our services with confidence.

 

I.  Definitions

1.  [Cherry Cloud]: Refers to the application developed by Cherry Solution that connects to the Cherry Solution Smart Platform and provides device services to users.

2.  User Personal Information: Refers to information that can identify a user, such as name, date of birth, ID number, address, phone number, account number, and password, alone or in combination with other information, as well as information such as the time and location of service usage (hereinafter referred to as "Personal Information").

3.  Usage: We collect information from the device you use to access the services, along with information related to these devices. This includes: IP address, the type of browser and device you use, the web pages you visited before accessing our website, and identifiers associated with your device Your device may also transmit location information to the Services, depending on your device settings.

 

II.  Collection of Information

1.  Personal Information We Collect

During your use of Cherry Solution’s services, we will collect the following information that you voluntarily provide or that is generated by receiving Cherry Solution services. The information will be used to provide you with services, optimize our services, and protect your account and user experience.

a.  User Account Information: To use our products and services, you will need to create an account. During account creation process, we will ask you to provide PII (Personally Identifiable Information) such as your email address or mobile phone number. This information helps you activate, manage, or use Cherry Solution's services. We will associate your nickname, avatar, country, and time zone with your account to facilitate your access to our products and services.

b.  User Device Information: We will collect information such as your device model, operating system, unique device identifier, login IP address, Cherry Solution software and hardware version numbers, network  access method and type, to provide PUSH notifications. This information is also essential for us to provide our services.

c.  Images/Video Information Captured by Camera: If you enable camera access when using our services, we will collect image/video information captured by your camera. This information will be used for device scanning and recognition services.

d.  Feedback Information: We will collect your feedback to help you with troubleshooting.

e.  Infrared Information: We will collect your infrared remote-control information to enable you to operate your other infrared devices through the App.

f.  User Scene ( Linkage ) Information: When you use functions such as scenes or automations, we will collect your relevant setting information to provide you with smart scene services and for the use of such information.

We use personal information for internal purposes such as auditing, data analysis, and research, allowing you to better enjoy the comprehensive services we provide and enabling us to improve our products and services. The personal information we collect allows us to keep you informed of Cherry Solution's latest product releases, software updates, changes to terms, and upcoming events. This information also helps us improve the personalization of our services and provide you with personalized services. If you participate in a lottery, contest, or similar promotion, we will use the information you provide to manage and administer such activities.

2.  How We Collect and Use Your Personal Data

Personal data refers to information that can be used to identify an individual, whether alone or in combination with other information. Such data may be submitted directly to us when you use our software products and services and interact with us, for example, when you create an account or contact us for support; or it may be obtained by recording how you interact with our software products and services, for example, through technologies like Cookies, or by receiving usage data from software running on your device. Where permitted by law, we may also obtain relevant data from public and commercial third-party sources. We also collect information you provide to us and the content of messages you send to us, such as information of search queries you enter or questions or information you provide to obtain customer service support. You may be requested to provide your personal data when using Cherry Solution products or services.

3.  How We Use Cookies and Similar Technologies

To ensure the normal operation of the software, we will store small data files called [Cookie] on your computer or mobile device. Cookies typically contain an identifier, site name, and some numbers and characters. The primary functions of Cookies are to facilitate your use of software products and services, and to help the platform count unique visitors, among other things. By using Cookie technology, we can provide you with a more thoughtful user experience service and allow you to set your specific service options.

When you use Cherry Solution's products and services, Cookies will be sent to your device. When you interact with services we provide to partners (such as advertising or promotional services, and Cherry Solution-provided service features that may appear on other software), we allow Cookies (or other anonymous identifiers) to be sent to Cherry Solution's servers. We will not use Cookies for any purposes other than those described in this Privacy Policy. You can manage or delete Cookies based on your preferences.

III.  Disclosure of Information

1.  Disclosure to Third Parties

a.  Depending on the circumstances, we may provide certain personal information to partners who collaborate with Cherry Solution to provide products and services or assist Cherry Solution in marketing to its customers. We will only share personal information with third parties for the purpose of providing or improving our products, services, and advertising; we will not share personal information with third parties for their own sales purposes, nor will we sell personal information. We are obligated to require the aforementioned partners to strictly abide by confidentiality agreements and the requirements of this Information Protection Policy.

b.  We may provide our partners with statistical information on your smart terminal usage from time to time. Such statistical information does not involve personal information such as your name, account number, password, phone number, or email address.

c.  If our partners have expressly disclosed to you the information collected and the purpose of its use in accordance with the law, and have obtained your consent, we may disclose your personal information to such third parties based on your authorization. For the security of your personal information, we may desensitize or obfuscate your personal information before disclosing it to third parties.

2.  Disclosure of Information under Special Circumstances

a.  We may be required to disclose your personal information in response to lawful requests from government authorities.

b.  If we determine that disclosure is reasonably necessary to enforce our terms and conditions, protect our operations or users, or where significant public interest is involved, we may disclose information related to you.

c.  In the event of a reorganization, merger, or sale, we may transfer all personal information we have collected to the relevant third party.

IV.  Retention Period and Deletion of Information

We will retain your information for the period necessary to fulfill the purposes outlined in this Personal Information Protection Policy, unless a longer retention period is required or permitted by law. During your use of Cherry Solution services, you may  cancel your account and delete related personal information at any time via "Me - Settings - Account & Security".

V.  Protection of Personal Information

We take various precautions to protect your personal information from  loss, theft, and misuse, as well as unauthorized access, disclosure, alteration, or destruction. To ensure the security of your personal information, our company has strict information security regulations and procedures, and a dedicated information security team that strictly enforces these measures within the company. Your information is stored on servers located in China. For security and backup purposes, we may store your information and data on the servers of other affiliated companies.

We provide corresponding security measures to prevent loss, misuse, unauthorized access, or disclosure of your information:

(1)  We strictly comply with laws and regulations to protect user information.

(2)  We have established dedicated management systems, processes, and organizations to ensure information security. For example, we strictly limit the scope of personnel who can access information, require them to abide by confidentiality obligations, and conduct appropriate reviews.

(3)  In the event of a security incident, such as a personal information breach, we will initiate emergency response plans to prevent the incident from escalating, and will inform you through appropriate and legally compliant means such as announcements.

VII.  Policy Updates

We may amend and update this Policy at any time and will publish a notice on our website 30 days in advance. If you continue to use the relevant services of the Cherry Solution Smart Platform after the effective date of any amendments or updates, you will be deemed to have agreed to the amendments and updates.

We may revise the content of this Policy from time to time. If such changes would substantially impair your rights under this Policy, we will notify you by providing a prominent notice on the page before the changes take effect. For major amendments, we may also provide more noticeable notification depending on the circumstances (including, for certain services, in-app notifications detailing the specific changes to the Privacy Policy). In any case, your continued use of our services constitutes your agreement to be bound by the amended Policy.

Major changes referred to in this Policy include, but are not limited to:

1.  Major changes in our service modes, such as the purpose of processing user information, the types of user information processed, and how user information is used.

2.  Major changes in our control, organizational structure, etc., such as changes in ownership due to business adjustments, bankruptcy reorganization , mergers and acquisitions, etc.

3.  Significant changes in the main objects of user information sharing, transfer, or public disclosure.

4.  Significant changes in your rights regarding the processing of user information and how they are exercised.

5.  Significant changes occur to the department responsible for handling user information security, contact information, and complaint channels (for the avoidance of doubt, daily internal operational adjustments are not included).

6.  When a user information security impact assessment report indicates a high risk.

We recommend that you regularly review the latest information on our privacy practices. Your continued use of the services on your mobile phone or any other device will be deemed acceptance of the updated Privacy Policy.

VIII.  Governing Law and Jurisdiction

This Policy is formulated in accordance with and shall be governed by the laws of the People's Republic of China. Any disputes arising from or relating to this Policy may be resolved through friendly negotiation with Cherry Solution or filed  to the Xiaoshan Primary  People’s Court, Hangzhou, for adjudication.

 

You (the user) hereby confirm that you have fully read, understood, and accepted the entire contents of this Personal Information Policy before agreeing to or actually using the Services in any other manner permitted by the Company. Your use of the Services constitutes your agreement to all terms of this Personal Information Policy. If you do not agree to the terms of this Privacy Policy, you will not be able to use the services we provide you.
